The cases specifically involve West Virginia and Idaho, now among at least 27 states with laws that prohibit biological males from competing against biological females, according to news reports. State officials argue the laws are fair and protect female athletes — and are also consistent with Title IX. Plaintiffs in the two cases, supported by the ACLU, claim the bans violate equal protection and federal law. Meanwhile, the White House is backing the states.

A ruling on the two cases is expected by early summer.
